Welcome to The Chefs Community Hub. These Terms and Conditions (“Terms”) govern your access to and use of our platform, including our website, marketplace, subscriptions, communication tools, and advertising services (collectively, the “Services”). The Services are owned and operated by The Chefs Community Hub (“we,” “us,” or “our”).
By creating an account, purchasing products, or using any part of our platform, you agree to be bound by these Terms. If you do not agree, you must immediately cease using the platform.
- JURISDICTION AND GOVERNING LAW
The Chefs Community Hub is operated from New South Wales, Australia. Regardless of your physical location or the country from which you access the Services, these Terms are exclusively governed by and construed in accordance with the laws of the State of New South Wales and the federal laws of the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia to resolve any dispute arising under these Terms. - ACCOUNT SECURITY AND PRIVATE LOG-IN DETAILS
To access certain features, you must register for an account.
- You are solely responsible for maintaining the strict confidentiality of your account log-in details, usernames, and passwords.
- You must not share your log-in credentials with any third party.
- You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your log-in information.
- DIGITAL DOWNLOADS AND INTELLECTUAL PROPERTY
Our platform offers digital downloads, including but not limited to commercial recipes, proprietary images, digital guides, and related digital products.
- License: When you purchase or download a digital item, you are granted a non-exclusive, non-transferable, revocable license for its specified use (e.g., commercial kitchen use).
- Restrictions: You may not resell, redistribute, sub-license, or publicly share the raw digital files, commercial recipes, or images unless explicitly permitted in writing by the content creator or us.
- All intellectual property rights in the platform’s native content, layout, design, and trademarks remain the property of The Chefs Community Hub.
- MARKETPLACE: INGREDIENTS, MACHINERY, EQUIPMENT, AND UTENSILS
We facilitate or directly engage in the sale of physical commercial kitchen goods, including raw ingredients, cooking machinery, heavy equipment, and kitchen utensils.
- Product Descriptions: We endeavor to display accurate product descriptions, weights, and specifications. However, we do not warrant that descriptions are completely error-free.
- Australian Consumer Law (ACL): For customers in Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
- International Orders: If you purchase physical goods from outside Australia, you are responsible for ensuring compliance with your local import laws, customs regulations, duties, and health/safety standards.
- SUBSCRIPTIONS AND ONLINE PAYMENT METHODS
- Billing: Access to premium tiers, member features, or recurring services requires a paid subscription. Subscription fees are billed in advance on a recurring, periodic basis (monthly or annually).
- Payment Processing: All online payments are handled via secure, third-party payment gateways. By providing your payment details, you authorize us (via our processors) to charge all due fees to your selected payment method.
- Cancellations: You may cancel your subscription at any time through your account dashboard. Cancellations apply to the next billing cycle; refunds are not provided for partial subscription periods except as required by the ACL.
- COMMUNITY CHAT AND MEMBER CONDUCT POLICY
Our platform includes interactive chat features, forums, and direct messaging tools to connect members. We maintain a zero-tolerance policy for toxic or harmful behavior. You strictly agree not to post, share, or transmit any content that:
- Discriminates against, harasses, degrades, or intimidates any individual or group on the basis of race, ethnicity, cultural background, religion, faith, gender, sexual orientation, age, or disability.
- Contains hate speech, defamatory remarks, profanity, or threats of violence.
- Impersonates another chef, business, or individual.
We reserve the right to review, moderate, or immediately delete violating content and permanently ban offending accounts without notice or refund.
- JOB SEARCH, WANTED ADS, AND ADVERTISING PLATFORM
Our Services allow users to post employment ads (“Job Search”), material requests (“Wanted Ads”), and publish targeted commercial advertisements (similar to Google AdWords/AdSense features).
- Job & Wanted Ads: Users posting ads are solely responsible for ensuring the accuracy, legitimacy, and legality of their listings. Employment ads must comply with Fair Work Ombudsman regulations and anti-discrimination laws in Australia.
- Display Advertising Program: Advertisers purchasing banner, contextual, or targeted ads must supply content that complies with all advertising standards and Australian consumer protection laws against misleading or deceptive conduct. We do not guarantee specific click-through rates, impressions, or conversions. We reserve the right to reject or remove any advertisement that violates our community standards or commercial policies.
- THIRD-PARTY LINKS AND EXTERNAL SITES
The platform contains links to external websites, supplier networks, or third-party service providers. These links are provided for convenience only. The Chefs Community Hub does not endorse, control, monitor, or accept responsibility for the content, privacy policies, practices, or availability of any external third-party sites. - LIMITATION OF LIABILITY
To the maximum extent permitted by the laws of New South Wales and the Commonwealth of Australia, The Chefs Community Hub and its directors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages. This includes, without limitation, loss of profits, data corruption, kitchen downtime, equipment failure, or business interruption arising out of your use of the marketplace, recipes, or community chat features. - AMENDMENTS
We reserve the right to modify these Terms at any time to reflect changing legal requirements or operational updates. We will notify members of significant updates via email or a prominent notification on the platform. Your continued use of the platform after updates are published constitutes binding acceptance of the revised Terms.
